This Toki Privacy Policy (the "Policy") applies to all personal information collected, used, and processed by Toki ("we," "us," or "Toki")—the operator of the Toki social content platform, including the Toki App, the official website (www.toki.chat), and all associated services (collectively, the "Toki Services").
This Policy governs our handling of personal information from "users"—including visitors to the Toki Services, registered account holders, content creators, viewers, and anyone who interacts with the Toki platform. By accessing or using the Toki Services, you acknowledge that you have read, understood, and agreed to the terms of this Policy.
We obtain information about you through the means discussed below when we provide the Toki Services. Please note that we need certain types of information so that we can provide the Toki Services to you.
You may choose to provide personal information when using the Toki Services (e.g., registering an account, creating content, or contacting support). This includes:
● Account Registration Information: Date of birth (to verify age eligibility), phone number/email address (for account verification and login), password (encrypted for security), unique user ID, and preferred language.
● Profile Information: Alias, profile photo, gender (optional), hometown (optional), self-introduction, social media account links (if you choose to connect), education/career details (optional), and other information you actively add to your profile.
● User-Generated Content (UGC): Comments, text, messages, photos, videos, audio, stickers, code, or other materials you upload, stream, post, or transmit on the Toki Services (e.g., live streams, forum posts, or private chats).
● Facial Data (Where Applicable): If you use Toki's special effect/emoji features for live streams or photos, we may process facial data offline only to enable these functions. We will not use this data for other purposes (e.g., marketing) unless we obtain your explicit consent, or de-identify the data. For "Real-Person Profile Authentication" (to prevent fake accounts), we collect your profile photo and a short facial-recognition video—this video is used only for verification and is not stored on our servers after authentication.
● Payment & Transaction Information: Bank account details, PayPal or other payment method information (when you purchase paid services), transaction serial numbers, and purchase history (e.g., virtual tokens, gifts, or subscription records).
● Social Network Contacts: With your permission, we may access your device's contact list when you use the "Discover Friends" feature to find other Toki users.
● Location Information: GPS data (if you enable location permissions on your device) to provide location-based features (e.g., discovering nearby users or region-specific content). You can disable this permission at any time via your device settings.
● Correspondence & Opt-In Choices: Information you provide when contacting Toki support (e.g., feedback, complaints, or account verification), and your preferences for notifications (e.g., push alerts for live streams or messages).
● Third-Party Account Information: If you register or log in to Toki via a third-party social media account (e.g., Facebook, Instagram, Google), we collect the information you authorize the third party to share (e.g., your name, profile photo, or friend list)—as specified by the third party's privacy policy.
We may collect some or all of the following Personal Information about you when you use Toki Services for legitimate interests:
● Network & Usage Activity: Browsing history on the Toki platform, search queries, videos/pages you view, date/time of visits, accounts you follow/subscribe to, and your interactions with other users (e.g., likes, comments, or gift-giving records).
● Device Identifiers: Operating system (e.g., iOS/Android), browser type, device brand/model/serial number, IP address, mobile carrier, screen resolution, language settings, IMEI number, IMSI number, and MAC address.
● App Usage Data: Information about how you use other apps on your device (only if permitted by your device settings, and used to optimize Toki's compatibility with your device).
● Non-GPS Location Data: Approximate location based on your SIM card's region or IP address (to provide region-specific content or comply with local regulations).
● Mobile Advertising Identifiers: Apple's IDFA or Google's AAID (used to deliver personalized ads that align with your interests, and to measure ad effectiveness).
● UGC Metadata: Data describing your UGC, such as hashtags, captions, upload time, and device used to create the content (to organize, categorize, and improve the discoverability of your content).
● Cookies & Similar Technologies: Small data files stored on your device to enable core features (e.g., remembering your login status, personalizing your homepage, or analyzing usage patterns). We may also use web beacons (pixel tags) to track how you interact with Toki's content and ads. For details on how we use cookies, see our separate Toki Cookie Policy.
We will only use your Personal Information when the applicable laws allow us to. In general, we use your Personal Information for the following purposes:
Provision of services: to present Toki Services and its contents to you, including any interactive features on Toki Services, and to provide you with information, products or services that you allow us to; we also collect and use Personal Information to verify your eligibility and deliver prizes in connection with promotion activities and sweepstakes;
Improvement of services: to improve and personalize our services by presenting new services, information, recommendations, and feedback;
Customer management: to manage a registered user's account, to provide customer support and notices to the registered user about his account or subscription, and notices about changes to Toki Services or any other product or service we offer or provide through it;
Communication: to communicate and interact with you directly, for an example, we may send notifications regarding upcoming changes, promotion activities or improvements on Toki Services;
Content review: to review pictures, images and contents posted or generated on Toki Services to ensure that we comply with any applicable content regulations in any relevant jurisdiction;
Customization of content: to perform research and analysis about your use of, or interest in contents, products, advertising, or services available on Toki Services in order to develop and display content tailored to your interests on our Website and App;
Performance Analysis: to determine whether users of Toki Services are unique, or whether the same user is using Toki Services on multiple occasions, and to monitor aggregate metrics such as total number of visitors, number of videos viewed, demographic patterns;
Functionality and security: to identify users not meeting the age limit, to diagnose or fix technology problems, and to detect, prevent, and respond to actual or potential fraud, illegal activities, or intellectual property infringement;ƒ
Compliance: to enforce our terms of use and to comply with our legal obligations;
Aggregation: to aggregate information we collect about you to which one or more purposes described above.
Cookie: We and our vendors and service providers use cookies and other similar technologies (e.g., web beacons, flash cookies, etc.) ("Cookies") to automatically collect information, measure and analyze which web pages you click on and how you use the Platform, enhance your experience using the Platform and improve our services. Cookies are small files which, when placed on your device, enable the Platform to provide certain features and functionality. Web beacons are very small images or small pieces of data embedded in images, also known as "pixel tags" or "clear GIFs," that can recognize Cookies, the time and date a page is viewed, a description of the page where the pixel tag is placed, and similar information from your computer or device. By using the Platform, you consent to our use of Cookies.
Additionally, We link your contact or subscriber information with your activity on our Platform across all your devices, using your email or other log-in or device information. We are not responsible for the privacy practices of these third parties, and the information practices of these third parties are not covered by this Privacy Policy.
You may be able to refuse or disable Cookies by adjusting your browser settings. Because each browser is different, please consult the instructions provided by your browser. Please note that you may need to take additional steps to refuse or disable certain types of Cookies. In addition, your opt-out selection is specific to the particular browser or device that you are using when you opt out, so you may need to opt-out separately for each of browser or device. If you choose to refuse, disable, or delete Cookies, some of the functionality of the Platform may no longer be available to you.
Note that we may process your Personal Information for more than one lawful ground depending on the specific purpose for which we use your Personal Information.
Please note that if your profile is public, your content will be visible to anyone on the Platform and may also be accessed or shared by your friends and followers as well as third parties such as search engines, content aggregators and news sites. You can change who can see a video or a picture each time you upload a video
We may also share your information with other members, subsidiaries, or affiliates of our corporate group, to improve, optimize the Platform and to prevent illegal use.
We may share your Personal Information outside of Toki Services when we have your consent, either express or implied.
We may disclose your Personal Information to members of our corporate group (that is, entities that control, are controlled by, or are under common control with us) to the extent this is necessary for services, customer management, customization of content, advertising, analytics, verifications, functionality and security, and compliance.
We may disclose your Personal Information to our authorized service providers that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, customization of content, analytics, security, map navigation, data storage and cloud services, supporting our functionality, and other features offered through Toki Services. These service providers may have access to Personal Information needed to perform their functions but are not permitted to share or use such information for any other purposes. However, if you connect to a third-party service through Toki Services or otherwise links your Toki account with a third-party service, you are requesting and authorizing us to share or grant access to information on your behalf with such third party. We may also send information about the content that you watched or your activities on Toki Services to such third party in order to upgrade your experience on Toki Services.
We access, preserve and share your Personal Information with regulators, law enforcement or others where we reasonably believe such disclosure is needed to (a) comply with any applicable law, regulation, legal process, or governmental request, (b) enforce applicable terms of use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address illegal or suspected illegal activities, security or technical issues, (d) protect against harm to the rights, property or safety of our company, our users, our employees, or other third parties; or (e) to maintain and protect the security and integrity of Toki Services or infrastructure.
Your Personal Information may be processed by us, our trusted third party suppliers outside of the country (s) in which you reside, including in countries where data protection and privacy laws or regulations may be equivalent to, or as protective as, the data protection laws and regulations in your country. In accordance with applicable data protection and privacy laws and regulations, we will implement appropriate measures to ensure that your personal information remains protected and secure when it is transferred outside of your country to a jurisdiction that has a less adequate level of protection of personal data.
We may also transfer your personal information outside of your country as permitted by applicable data protection and privacy laws and regulations. Examples include where we need to transfer your personal information: (a) to perform a contract with you (or to take steps before the contract at your request); (b) perform a contract in your interests; or (c) in relation to legal claims.
When you click on a link to any other website, mobile application or third-party content through Toki Services, you will go to another website or other mobile application and another entity may collect information from or about you. We have no control over, do not review, and cannot be responsible for, these third-party websites or mobile applications or their contents. Please be aware that the terms of this privacy policy do not apply to these third-party websites or mobile applications or content, or to any collection of information after you click on links to these third-party websites, mobile applications or content.
We take appropriate administrative, technical and physical security measures to safeguard your Personal Information from unauthorized access and disclosure. Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of your Personal Information. You should use caution whenever submitting information through Toki Services and take special care in deciding which information you provide us with.
You are responsible for maintaining the secrecy of your password and account information at all times.
You are advised not to display any personal contact or banking information on your individual profile page whether in relation to you or any other person (for example, names, home addresses or postcodes, telephone numbers, email addresses, URLs, credit/debit card or other banking details). If you do choose to reveal any personal information about yourself to other users, whether via email or otherwise, it is at your own risk.
You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.
You can at any time request to opt out from allowing us to send you push notifications by adjusting the permissions in your mobile device.
You can switch off GPS location, Microphone, Camera or other similar functions on your mobile device if you do not wish to share them. You can also hide your location, videos uploaded, recent active time and other information by adjusting "Privacy" setting.You can choose not to provide us with Personal Information, but that may result in you being unable to use certain features of Toki Service.
You can change the mobile advertising identifiers in your mobile device or limit advertising tracking through your mobile device's privacy settings. You can make changes to your information, including accessing your information, correcting or updating your information or deleting your information by editing your profile in the App.
Users must be at least 18 years of age to utilize our services. In your usage, we will not intentionally collect your personal information but may collect your age data to confirm your adherence to the use standards of our application. In case we unintentionally gather personal information from users under the age of 18, such data will be promptly removed from our databases, which also implies that your account will be banned accordingly. Thus, we advise against the use of our services by individuals below 18 years.
Should you encounter prospective instances of Children Sexual Abuse Content (CSAM) during your utilization of the App, please use the app's report feature to inform us. Our product support team is available 24/7, allowing for quick processing of your report.
We will retain your Personal Information and other information for as long as you maintain your Toki account.
You may request deletion of your account at any time through the Me > Settings > Account > Delete Account menus in the app, or through sending email to xxxxxxx . Following such request with appropriate review by us, we will delete the data that it is not required to retain for purposes of regulatory, tax, insurance, litigation, or other legal requirements. In certain circumstances, we may be unable to delete your account, such as if there's a balance on the account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, we will delete the account as described above.
We may also retain certain information if necessary for purposes of safety, security, and fraud prevention. For example, if we deactivate a user's account because of unsafe behavior or security incidents, we may retain certain information about that account to prevent that user from opening a new Toki account in the future.
We may modify or revise our privacy policy from time to time. Although we may attempt to notify you when major changes are made to this privacy policy, you are expected to periodically review the most up-to-date version found at Toki Services so you are aware of any changes, as they are binding on you.
If we change anything in our privacy policy, the date of change will be reflected in the "last updated date". By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
For the safety of your account management, we provide a quick delete account function in the App. You can click Account Settings in the App Settings to view the Delete Account option. After clicking, you can follow the prompts to guide the user to delete the account. For the security of your account property, after you confirm the deletion of account information, you will log out and we will keep your account for 7 days. Within 7 days, you can log in again at any time to retrieve your account and keep all account information. After more than seven days, we will delete all your account data and it cannot be retrieved by any means.
